The part touching would have to be exactly level, and does that mean level to the ladder rung plane, or to the floor, or to the local gravitational vector…
To be considered hanging a robot must be touching the ladder and be completely above the plane which is parallel to the floor and tangent to the top of the ladder rung specified in the specific type of hanging definition.

If the ladder is unmoved, or at least still has all four legs touching the foam tiles,
the ladder rung reference plane deviates only slightly from the floor plane, by the tolerances of ladder and the weight imbalance that depresses some legs into the foam more than others.
In this most common case, using the ladder as a reference plane would be the most practical, since a ref could sight through the ladder from rung to rung.
If the ladder is tilted (eg: two legs are on top of a robot), then there is more of a difference between the floor reference plane and the rung reference plane. If tilted toward the rungs, both rungs are higher than spec originally. If tilted toward the side, then both rungs are significantly higher at one end of the rung.
In this boundary case (which seems unlikely, but that has been made legal by saying that moving the ladder is legal), using the ladder as reference plan may lead to undesireable results. When using the floor as a reference plane in this case, what part of the rungs are the upper reference?
Practically speaking, I don’t see how to use the floor as a reference plane without additional expensive equipment, such as a transit, laser level, hanging reference boxes to place under, etc.
